These Terms & Conditions apply to all website services provided by Accountantly Ltd, trading as CyteKick (“we”, “us”, “our”). By purchasing a CyteKick website package and confirming acceptance of these Terms & Conditions, you (“the client”, “you”, “your”) agree to the following.

1. Package Scope

1.1 We provide website design and build services based on the package selected at the time of purchase (Established, Growth, PowerHouse) and the features listed on our website or checkout page at the time you order.

1.2 Page limits and inclusions are defined by the package you choose. Any request outside the package scope (for example: additional pages, new functionality, additional integrations, or major design changes) is classed as additional work and will be quoted separately.

1.3 We may decline requests that fall outside of the purchased package scope unless agreed in writing.

2. Project Start and Payment Terms

2.1 Work will only begin once the first payment has been received and cleared. No work is scheduled or started before payment clears.

2.2 Payment options:

  • Monthly plan: You agree to monthly payments for 12 months. The first payment secures your place in our build schedule.
  • Upfront payment: 50% is payable upfront to start work. The remaining 50% is due on completion and before final handover.

2.3 All payments are non-refundable once work has started, as time and resource is allocated to your project.

2.4 If payments are late or fail, we may pause work until payments are brought up to date. Timelines may be extended and we may suspend hosting or access where applicable.

3. Project Timelines

3.1 Estimated maximum timelines (subject to client input and approvals):

  • Established and Growth: up to 30 days
  • PowerHouse: up to 8 weeks

3.2 We aim to complete projects sooner where possible. If additional time is required due to complexity or unforeseen issues, we will let you know.

3.3 Delays in providing content, feedback, approvals, or access details can extend the timeline.

4. Client Responsibilities

4.1 You are responsible for providing accurate and complete content, branding, and business information, including any text, images, logos, or documents we request.

4.2 You confirm you have the rights to use any content you supply. We are not responsible for copyright or licensing issues related to materials provided by you.

4.3 You agree to review deliverables and provide feedback promptly to keep the project moving.

5. Revisions and Feedback

5.1 Your package includes up to three rounds of revisions within the original agreed scope.

5.2 Revisions cover adjustments to layout, design, and content placement based on the agreed direction. Requests that introduce new features, new pages, major structural changes, or new functionality may be quoted as additional work.

5.3 To keep projects running smoothly, feedback must be provided within 7 days of a revision being shared.

5.4 If no feedback is received within 7 days, the work will be considered approved and the project will move to the next stage.

5.5 Delays in feedback may extend the overall timeline.

6. Hosting and Website Management

6.1 All CyteKick website packages include hosting and basic site management for the first 12 months at no additional cost, unless otherwise stated.

6.2 Hosting is required for all websites, regardless of who builds or manages the site. It is the service that keeps your website online and accessible.

6.3 After the initial 12-month period, you may choose to continue hosting with CyteKick or move your website to another hosting provider.

6.4 If you continue hosting with CyteKick after the first 12 months, hosting will be charged at £12.50 per month.

6.5 If you choose to move your website to another hosting provider, we can assist with migration for a one-off migration fee of £149, to cover our time transferring the site safely.

6.6 You do not need to decide about post-12-month hosting at the time of purchase. We will contact you before the end of the initial 12-month period to confirm your preference.

6.7 You are not locked into hosting with CyteKick. The choice to stay or move is always yours.

7. Domain Names

7.1 Your domain name (your website address) is a core part of your business identity. For this reason, you must purchase and own your domain directly through a domain provider of your choice.

7.2 This ensures you retain full ownership and control of your domain, regardless of who builds or hosts your website.

7.3 We do not purchase, renew, or manage domain names on behalf of clients.

7.4 You are responsible for purchasing your domain, renewing your domain when due, and keeping your domain registration active and up to date.

7.5 We can guide you on domain setup if needed, but ownership and renewal remain your responsibility.

7.6 If a domain expires, your website and email may stop working. We are not responsible for downtime or loss caused by an expired domain.

8. Third-Party Services and Costs

8.1 Your website may rely on third-party services (for example: booking tools, email services, or external integrations). These may have their own fees and terms.

8.2 We are not responsible for third-party outages, changes, price increases, or features being removed by external providers.

8.3 If your project requires a paid plugin or service, we will discuss it with you before any purchase. Where possible, we will recommend cost-effective solutions.

9. Ownership and Portfolio Use

9.1 Once full payment has been received, you own your website content and the final website build.

9.2 We may showcase completed work in our portfolio, website, or social media unless you request otherwise in writing.

10. Liability and Legal Compliance

10.1 We take reasonable care to deliver a functional and secure website. However, we are not liable for loss of business, profit, revenue, or data, downtime caused by third parties, security incidents beyond reasonable control, or issues caused by client edits, third-party plugins, or third-party services.

10.2 You are responsible for ensuring your website content meets any legal or regulatory requirements relevant to your business (including privacy, cookies, and any industry-specific requirements). Any templates or guidance we provide are for general use and should be reviewed for your situation.

11. Pausing, Cancellation, and Termination

11.1 We may pause or terminate services if payments are not made, required content or access is not provided for an extended period, or there is a breach of these terms.

11.2 If the project is cancelled after work has started, payments already made are non-refundable due to time and resource allocation.

11.3 Where appropriate, we will provide the work completed up to the cancellation point, subject to payments being up to date.

12. Governing Law

12.1 These Terms & Conditions are governed by the laws of England and Wales, and any disputes will be handled under that jurisdiction.

13. Acceptance

13.1 By submitting your order, making payment, and ticking the acceptance box on our form or checkout, you confirm that you have read, understood, and agreed to these Terms & Conditions.
